The Government has extended the force majeure ERTE for the sectors most affected by the crisis with the agreement of the social agents, after including two new types of ERTE to which all companies affected by administrative measures to stop COVID outbreaks can benefit. -19.

The new scheme of Temporary Employment Regulation Files (ERTE) that will govern in the next four months establishes three types of files with different exemptions in the fees that companies pay for their workers and maintaining the conditions of unemployment benefits.
On the one hand, there are the ERTE due to force majeure, to which the activities most affected by the pandemic will be eligible, as well as the companies that demonstrate dependence on them, and which are part of a short list that will be known once the Bulletin State Official (BOE) publishes the decree, probably tomorrow, but which will fundamentally cover transportation and tourism.
In these cases, during the four months that the extension lasts, companies will have exemptions of 85% for those with fewer than 50 workers and 75% for those with more, both for activated employees and those who remain unemployed. The agreement reconverts the figure of the ERTE of regrowth, introduced in the previous June extension, into two new modalities, the ERTE of impediment and the ERTE of limitation.
Any company, from any sector, can benefit from them if it is affected by restriction measures to deal with COVID-19. In the ERTE of impediment, the bonuses will be 100% for companies with less than 50 workers and 90% for those with more than 50. In the second, the limitation one, the bonus scheme is decreasing starting from 100% in October to go to 90% in November, 85% in December and 80% in January for companies with less than 50 employees, while for those with more than 50 employees ten points must be subtracted from the previous percentages.
Finally, the improvement in aid has managed to unblock an agreement that maintains many of the previous points, such as the obligation to maintain employment for 6 months for companies covered by an ERTE or the prohibition of working overtime. Regarding benefits, workers affected by an ERTE will keep the "counter at zero" , that is, they will not consume benefits in the face of a possible future dismissal, throughout 2021, while an extraordinary unemployment benefit will be recognized for people workers with discontinuous permanent contracts.
It is also stated that people affected by an ERTE will have preferential attention to receive training courses with specific actions for this group. Currently, some 600,000 workers are still covered by an ERTE related to the COVID-19 pandemic compared to the 3.4 million who were covered at the peak of the pandemic in April.
The Government has also extended the protection for the self-employed group until January 31, expanding the benefit for cessation of activity, also that of the seasonal group, and implementing extraordinary instruments to protect some cases that had been left unprotected. The Minister of Inclusion, Social Security and Migration, José Luis Escrivá, has detailed that the aid associated with ERTE and the protection of the self-employed amounts to around 22,000 million euros until September.
